ORDERS:
Per our general policy, items are entered into production schedule on receipt of 50% deposit, with balance payment to be requested and cleared through our bank a minimum one week prior to shipping date.
For customized orders, items are entered into production schedule only when full payment has been cleared through our bank.
Orders for extra accessories for the above items – to be itemized separately on the order/invoice and paid in full at order stage.
Payments are accepted exclusively via wire transfer (bank to bank), in Euro, USD or in local currency (PLN). Buyer shall, always, cover their bank fees, ensuring that the invoiced amount clears our bank account in full.
We are not and shall not be held responsible for any currency exchange fees incurred.
In all cases, payment of deposit for placing an order, equates/confirms acceptance of the terms and conditions of sale, presented on this page.
PRICING:
Orders shipping to individuals in European Union countries, will be charged the legally required 23% VAT.
Orders shipping to businesses in European Union countries, will be charged the legally required 0% VAT if an EU registered valid VAT number is provided. Otherwise, above instance applies.
Orders shipping to individuals or businesses outside European Union countries, will not be charged any taxes (net pricing applies). Buyer is responsible for import clearance and any applicable local taxes or import duties.
CFF Telescopes reserves the right to change pricing of any products or services if more than 24 weeks accumulate/have gone by the time when deposit payment was confirmed and our estimated delivery date.
DEPOSIT REFUND POLICY:
Refund of deposit may be requested at any time. Based on the manufacturing stage the ordered product is in and the individual customization requested at the time of order, deposit refund might be remitted by CFF Telescopes exclusively when a new buyer for the ordered items can be found.
Each request shall be treated individually. Please submit your cancellation notice via email.
GOODS REFUND/RETURN POLICY:
In accordance with EU law, the Buyer can return a purchased good and is eligible for a full refund, without giving any reasons, within 14 days of delivery. Delivery day is considered the day on which the item has been accepted by the Buyer or any other person who received the goods on Buyer’s behalf or per Buyer’s designation. Notification shall be made to the email address present on warranty papers.
Shipping costs for the aforementioned returns (to and from the Buyer) together with any fees associated with the refund shall be supported by the Buyer, in accordance with EU law. Their total amount shall be subtracted from the amount to be refunded. Only exceptions allowed are goods which are under warranty, proven to have manufacturing defects.
Buyer has the obligation to return the goods in the same state as shipped. Refund will be issued only after goods are inspected by CFF Telescopes and proven to have arrived in same state as shipped. Buyer will be liable for any damages that will diminish goods’ value or will make repairs necessary. All costs for such interventions will be transferred to the Buyer.
Shipping back must be made using original packaging; goods shall be packed in the same way as they were found inside the shipping box.
CFF Telescopes has the obligation of issuing the refund in maximum 14 days after goods are received, inspected and their return condition objectively evaluated. Refund will be issued using same means of payment. CFF Telescopes will not refund customs tax or duties for non-EU Buyers, however, we will provide all export/import documents to facilitate their refund by local authorities. Responsibility for submitting refund of local fees, taxes, duties is solely the Buyer’s.
Returns/refunds which are done/requested later than 14 (fourteen) days up to 3 (three) months after delivery, will be treated as follows:
* our standard products shall have ‘return shipping’ costs paid by the Buyer. Refund will be issued after inspection of the goods is done and their return condition is objectively evaluated. These goods will be subject to a 20% restocking fee.
* any customized products shall have ‘return shipping’ costs paid by the Buyer. Refund can’t be issued for such goods. CFF Telescopes will try to assist/help with their resale without having an obligation in doing so or being constrained by any time limit.
These goods will be subject to a 30% restocking fee.
* for goods returned, claimed to be defective, that are proven to work correctly by CFF Telescopes, for which misinterpreted manufacturing defects are due to use of third-party accessories like filters, cameras, or any other mechanical or optical devices, not manufactured by CFF Telescopes, all shipping costs shall be supported by the Buyer.
These goods will be subject to a 30% restocking fee.
Shipping back must be made using original packaging; goods shall be packed in the same way as they were found inside the shipping box. If original packaging is not available, the Buyer shall ship back the goods using packaging of the same quality and type.
In all cases, Buyer should send a written notification regarding goods return to the email address present on warranty papers.
Returns/refunds which are done/requested later than 3 (three) months after delivery, will be treated on an individual basis.
CFF Telescopes has the right to refuse all returns/refund claims that are submitted later than this term.
We shall accept returns of objective lenses or mirror sets, that are proven to have manufacturing defects, for an unlimited time after delivery.
Such cases will be treated separately, on an individual basis, considering the nature and magnitude of the defect.
Shipping back must be made using original packaging; goods shall be packed in the same way as they were found inside the shipping box. If original packaging is not available, the Buyer shall ship back the goods using packaging of the same quality and type.
All placed orders are non-binding, thus CFF Telescopes reserves the right to cancel any existing order at any time during manufacturing stage, without being held liable.
Cancellation notice will be sent in written form. Refund of the deposit paid shall be operated in maximum 48h after the cancellation notice will be sent and account data will be provided by the Buyer. Deposit refund will be remitted in full value.
CFF Telescopes will bear all bank fees associated with the refund. CFF Telescopes will not be liable to cover any bank fees resulting from inaccurate bank data provided by the Buyer.
Important - 'force majeure' refunds - unforeseeable circumstances that prevent CFF Telescopes from fulfilling a contract
* in all 'force majeure' situation, CFF Telescopes shall offer immediate alternative solutions and has the obligation of informing the Buyer to take a decision concerning their ongoing contract within 14 days of receiving the written information/notification from the Seller. If the Buyer does not comply or if the options/alternatives presented by CFF Telescopes are refused, CFF Telescopes will be automatically granted the power to revoke/cancel the contract unilaterally and offer full refund for the item ordered.
Any subsequent claims received from the Buyer, in relation to a revoked/cancelled contract, shall be null.*
LEAD TIMES:
All our lead times are estimates and are not guaranteed. Actual time may vary depending on number of orders we have and raw materials availability. CFF Telescopes reserves the right to schedule production in the most efficient manner for either lens or mirror manufacturing. As all our optics are hand finished to ensure quality, delivery time is not the essence of any sale or contract, but CFF Telescopes will, however, ensure that all delivery dates are met in the best way possible, without compromising quality.
SHIPPING:
Items are to be shipped in their flight cases (when provided as standard or ordered as extra accessory). These are further packed in cardboard boxes with protective foam and packing peanuts to prevent shock damage. Items purchased without a flight case are to be packed securely in cardboard boxes with protective foam and packing peanuts to prevent shock damage.
For an additional fee, we can crate any items at Buyer’s request.
All items are to be shipped fully insured, without exception.
INCOTERMS transport – Delivered at Place (DAP)
LIABILITY/CLAIMS:
CFF Telescopes is responsible for any damage/delay that may occur during manufacturing process and will take all necessary steps to correct the situation.
CFF Telescopes will inform the Buyer if any delays are caused by third party defects that fall out of our area of responsibility (example glass manufacturers, suppliers of aluminium).
CFF Telescopes will ensure in the best way possible that all items ordered meet or exceed the quality standards requirements, in both mechanical and optical components.
CFF Telescopes’ responsibility over the integrity of the OTA ends when handed over for shipping. During transit time liability falls in the hands of the carrier company, via insurance.
The Buyer and/or his agent should check the condition of packaging when goods are received and immediately inform the shipping agent and CFF Telescopes, not later than 24 working hours from delivery, of any obvious damage.
WARRANTY/CLAIMS:
Our OTAs are guaranteed to be free of manufacturing/workmanship defects for 2 (two) years after the date of purchase, to the original Owner.
Buyer and/or his agent must satisfy themselves as to the mechanical and optical quality of the items supplied and report defects or non-conformity within 14 days of delivery. Optics should be tested visually by star or artificial star test. The user must be capable of collimating optics to ensure optimum performance.
Warranty claims must be made within the warranty period, which starts at the time of delivery to the buyer or agent, and be supported by adequate evidence of problems originating in the manufacturing process. In no circumstances will warranty claims be accepted if refractor lens cells are split or disassembled for any reason, without our consent. Care should be taken in the use, cleaning and storage of optical equipment to ensure that it is maintained in good condition – if this is not the case, Warranty claims may be rejected.
Fair wear and tear of any supplied items or exposure to condensation, extreme temperature fluctuations or mechanical stress does not justify a Warranty claim. Any modification to telescopes in terms of machining and drilling of components may affect the Warranty and the Buyer should consult CFF Telescopes prior to any such work being undertaken.
In the case of a warranty claim, items to be returned to CFF Telescopes for investigation must be shipped at the buyer’s cost, pending inspection by our quality inspectors.
In all instances, EU law applies.
